Had accident driving Enterprise rental.Car being repaired in body shop.Do I ve to pay rent till it is repaired

Shemeka Laker: In most cases you do have to pay the rental car fees for the time it takes to repair the car. Unless you bought their insurance that they should have offered you at the time you rented the car.

Toshia Metzker: "Bundysmom" is correct. Enterprise is loosing the use of the car while it is being repaired, and you can be held liable for the cost of their loss.

Patricia Dornbos: Of course I think she should do the right thing and pay it all. However, since you gave her permission to drive and was a passenger along side her you might have difficulty in small claims court. Getting a 'judgment' from the court and actually collecting are two different matters, however. Maybe you can talk her into paying you a set amount every month ?

Carter Dewater: Technically, YES....ERAC is owed loss of use. They are losing income on that car and you owe for it. However, with all things in life...it's negotiable.

Marjory Stromme: You should only pay for ! the rental until you have returned the vehicle, therefore if you got in an accident, and they took the car back and gave you no replacement rental, then you don't owe for the remaining days while it was in the shop. If they did give you a replacement rental, then yes you would pay the remaining rental.If they try to charge you - you have no legal obligation to pay - as they took the rental car from you, and did not provide you with a replacement. You could definitely fight it - however I highly doubt Enterprise would do that....Show more
