Ulrike Hert: Both state governments and the federal government have granted *many, many* legal and financial rights and benefits to married couples. Granting those benefits to heterosexual couples and denying them to homosexual couples is discriminating, and as there is no valid basis on which to justify discriminating between the two types of couples, such discrimination violates the Equal Protection Clause of the Fourteenth Amendment. The only argument *against* gay marriage seems to be religious in nature, an! d basing the awarding of secular legal and financial benefits by our government on one religious group's beliefs violates the First Amendment. Think about it this way: You have two couples who live side by side. One couple is an 80-year-old man who's been married to his 25-year-old trophy wife for a year or two when he drops dead. The couple next door is a lesbian couple who are both 80 also and have been together for fifty years when one of them drops dead. The man married to the trophy wife leaves her as his widow, but also has four ex-wives, all of whom he was married to for eleven years. Under the current Social Security laws, the trophy widow and all of the ex-wives *all* get to collect the dead man's Social Security benefits if those benefits are higher than what they've earned on their own record, but the surviving partner in the lesbian couple doesn't get a penny of the benefits of her deceased partner of fifty years, even if she was disabled or maybe stayed home to! raise the couple's two adopted children, never earned much herself and! the deceased partner was the breadwinner. How is that fair? How does that promote stability and respect for marriage and monogamy? To make it worse, imagine that both the deceased lesbian partner and the deceased man have estates of four million dollars which they wish to leave to their respective partners. The trophy wife pays *0* in estate tax because of the marital deduction, the lesbian partner, if both had died before the end of 2008, pays approximately $1 million. Gay marriage opponents use the "will of the people" argument, but the majority does not get to do anything they want to in a constitutional republic like ours...the constitution and judges exist to protect the rights of minorities when the majority would infringe those rights. The majority of the population in the south in the 1950's was violently against school segregation, but that didn't mean the Supreme Court should have gone along with the "will of the people" in Brown v. Board of Education - segregati! on was wrong and the Supreme Court was right to declare it so even in the face of massive public opinion to the contrary. Gay marriage opponents also use the "slippery slope" arguments that allowing gay marriage will allow incestous marriages, marriages to animals, etc. This is simply not true, as with these other instances there are independent, valid, non-religious reasons to ban them, reasons which do not apply to adult, consenting human couples who happen to be of the same gender....Show more

Jude Colbenson: Between my parents and I, we probably have more gay friends than straight, and the hot-button topic of marriage o! ften comes up at gatherings, especially since several couples have rece! ntly travelled to make their relationship legal (we live in New York). Invariably, one of the straight friends will say to a gay couple "We're not going to get married until everyone can", which seems to produce mixed reactions. Some thank them whole-heartedly, wishing more straight couples would do the same, while others (with whom I tend to agree more) seem touched by the thought, but ultimately think that this is not enough to affect any sort of change. What others do or deal with should never come into the picture. This is one of the arguments from anti-marriage proponents. When heterosexuals refuse to marry (which is a sign of support) the anti-marriage proponents only see "see - gay marriage DOES effect conventional marriages!!".
